This website is operated by Driving Equality. Throughout the site, the terms“ we”, “us” and“ our” refer to Driving Equality. Driving Equality offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/or purchasing something from us, you engage in our“ Service” and agree to be bound by the following terms and conditions(“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Section 1a - Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

Section 1b - New Student Package

The New Student Package is only available for UK provisional license holders who haven't driven with Driving Equality before. It is a one time purchase offer for all new students, unless their test date is within 2 calendar months of the lesson booking. We reserve the right to cancel any bookings from students who attempt to book this package if they do not qualify. Refunds will be given, but service fees will apply and will be deducted from the order amount.

If a student books their driving test to be within 2 calendar months of using our New Student Package that lesson will retrospectively be charged as appropriate from our standard pricing.

Section 1c - Driving/Test Assessments

This is a 2-hour booking to assess your driving ability.

If you are a new student of Driving Equality with a test booked within 1 calendar month or have already passed your driving test, we require you to make this booking before accessing our standard pricing. This is so we can accurately address your needs.

These bookings are for assessment purposes only and are not to be used for test bookings.

Section 1d - Waiting Lists

Signing up to our waiting list is signalling an expression of interest for driving lessons provided by Driving Equality. This does not guarantee you will receive lessons, offered lessons in the time slots selected or receive priority treatment. We will do our best to use the information provided to meet the needs of our customers and will contact potential students when space is available.

There is no public waiting list for charitable lessons as these are handled by our referral partners based on needs.

Section 1e - Gift Cards

Our gift cards are not physical items and are solely digital products at this time. The imagery used to promote our gift cards is used for visual representation purposes only. Gift cards are currently only available to new students who have no prior driving experience, or the family, friends, colleagues or similar to the student. The gift cards themselves are priced with inclusive discounts and are therefore unable to be purchased in conjunction with other products or lessons for greater discounts. When purchasing a gift card, you must provide the name of the gift recipient who will be claiming the lessons where prompted to on checkout. All lessons received through a gift card purchase will be reserved immediately and will be available for booking to the named recipient. Lessons can be claimed and booked by contacting us at hello@drivingequality.co.uk or by filling out the form on our contact page, here on the website. We reserve the right to cancel any gift card purchases from returning and experienced students. Refunds on these gift cards are available if the lessons haven't been booked, but service fees will apply and be deducted from the order amount. In situations where lessons have been booked and learning has commenced, gift cards thereafter become non-refundable.

Section 2: Pricing and Payments

Section 2a - Completing Payments:

Payments should be completed at the booking stage. If making multiple bookings this only applies for your next lesson, all other payments are due 48 hours before your lesson’s start time. Failure to do so may result in the timeslot being offered to other students.

Any alternative payment arrangements made with your instructor must be confirmed in writing.

Section 2b - Missed Payments:

If you fail to make payments within the stated timeframe, you may incur an additional admin fee related to the time we spend resolving the issue.

If payments are repeatedly late or refused, we reserve the right to discontinue our service and, in exceptional circumstances, to take necessary legal action.

Section 2c - Lesson Bundles / Gift Card Expiry:

All hours of a Lesson Bundle must be used within 6 months of payment. All hours of a Gift Card must be used within 12 months of payment. Once these dates have expired you will no longer be eligible for any refunds or driving tuition.

Section 2e -Tracking Lessons and Payments:

Your driving instructor will keep a log of payments made and lessons taken. This will be provided at your next lesson if requested.

We encourage all students to keep a similar log.

Section 2f - Out-of-Hours, Motorway Refresher and Intensive Courses Pricing:

Our pricing structure sets prices from Monday to Friday, 08:00-18:00 and covers 2-hour lessons only. Our instructors are free to set their own pricing outside of our standard offerings (including bank holidays). They are also free to set their own pricing if engaging in a Motorway Refresher or Intensive Driving Course (classified as exceeding 4 hours of lessons in a single week).

These increases cannot exceed 25% of our standard pricing.

Any deviation from standard pricing for these times must be communicated and agreed in writing upon booking.

Our instructors cannot charge an increased rate if they are rescheduling a lesson they themselves have canceled.

Section 2g - Price Adjustments:

Driving Equality reviews its pricing structure annually with any changes coming into effect at the start of the UK financial year (6th of April). We retain the right to an emergency review and pricing change without notice in the case of major extraneous circumstances.

Current students will be notified a full calendar month in advance of any changes.

Any students starting after a pricing update will be subject to the new model. Any pre-paid lesson bundles or gift vouchers will be honored at their original hourly value.

Section 2h - Price Lock:

Students are guaranteed to remain on the current pricing structure for a period of 3 months from the payment date of their first lesson. We retain the right to withdraw this guarantee if the student has not taken lessons for a full calendar month or in the case of major extraneous circumstances.

Any pre-paid lesson bundles or gift vouchers purchased within this timeframe will be honored at their original hourly value.

Section 2i - Refunds:

You may request a refund for any unused hours purchased within the relevant expiry window. If a lesson bundle or gift voucher is being refunded, used hours will be deducted from the refund amount at our current hourly rate.

Refunds can take up to 14 days to process.

Section 3: Practical Driving Tests

Section 3a - Use of Instructor’s Car:

To qualify use of an instructor’s car for your driving test you must have completed at least 10 hours of tuition with that instructor. The instructor must then agree to this in writing at least 16 days before the test. Without this we cannot provide any guarantee.

The instructor can withdraw the use of their car if they believe the student does not yet meet the test standards or pose a danger on the day of the test.

In rare cases the car may need to be withdrawn at short notice due to mechanical issues.

Section 3b - Practical Test Lesson Booking:

If you wish to take your instructor’s car for your test, you will need to make a 2-hour booking. This enables an hour’s practice before the test, the test itself and gives time for your instructor to drive you home while providing a debrief.

If you are taking a test out of your local area, we may need to increase the booking time to allow for the above.

Section 3c - Practical Test Pricing:

The price for a test booking is the price you would usually pay your instructor for a normal booking on that time and day.

Section 4: Our Instructors

Section 4a - Franchisee:

Driving Equality operates as a franchise. Our instructors are self-employed and are regulated by the Driver & Vehicle Standards Agency (DVSA). In joining Driving Equality, they have agreed to our mission and to adhering to our policies.

Section 4b - Abuse Towards Our Instructors:

Driving Equality has a zero-tolerance stance on abuse. Any instance of abuse towards our instructors will result in immediate termination of your lesson. Regardless of location, you will be responsible for your own transport arrangements from this point. The lesson will still be charged as normal.

After a peer review of the event, future lessons may be cancelled and charged in full if they are within 48 hours of the incident.

Section 4c - Our Instructors Treatment of you:

You are entitled to always be treated with dignity and respect during your lessons. As a learner you may make mistakes, but in no way does this mean you should be yelled at or belittled.

If you feel you have been treated in an unacceptable manner, please contact Driving Equality directly. We take such instances extremely seriously as we strongly believe that all students should be treated respectfully during their lessons.

Please note that our instructors may very occasionally need to vary the tone and volume of their voices in order to draw a student’s attention to an emergency situation occurring during their lesson.

Section 4d - Complaints:

If you have any complaints or concerns regarding your instructor, please contact Driving Equality directly so we can address this. We investigate all concerns and will handle any malpractice appropriately.

If you wish to escalate the matter further, you can follow the DVSAs complaint procedure.

Section 4e - Lone Working:

Driving Instructors working with us follow lone working principles. They will always meet you at their car. They may need to make dynamic risk assessments and put control measures in place.

Section 5: Lesson Termination

Section 5a - Eligibility/Fitness to Drive

If at any point our instructors feel you do not meet eligibility criteria set by the DVSA or are unfit to drive, we retain the right to terminate the lesson without warning. In these instances, the lesson will still be charged in full.

Section 5b - Misinformation

If you have provided misinformation or misled Driving Equality in any way (such as your level of driving experience) we retain the right to terminate the lesson without warning. In these instances, the lesson will still be charged in full.

Section 5c - Communication Ability

If at any point our instructors feel you are unable to communicate with them effectively and/or are struggling to understand their instructions, we retain the right to terminate the lesson without warning. In these instances, the lesson will still be charged in full.

Section 5d - Termination Review

After a lesson termination your instructor will drive you to your drop of location. Driving Equality will conduct a peer review of the event. This can result in a withdrawal or pause in our service. Future lessons may be cancelled and charged in full if they are scheduled within 48 hours of the incident.

Section 6: Lost Items

Section 6a - Lost Items

Driving Equality is not liable for any items left in our vehicles. If you have lost an item, please inform your instructor and they will try to locate it. If the item is found, you can collect it at your next lesson.

If you wish to receive an item sooner your instructor may need to charge for the time it takes to deliver it to your address.

Section 6b - Postal Returns

If an item requires postal service to be returned, the student is liable for all material and service costs.

Section 7 - General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content(not including credit card information), may be transferred unencrypted and involve(a) transmissions over various networks; and(b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Section 8 - Accuracy, Completeness and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content there of) without notice at any time. We shall not be liable to you or to any third - party for any modification, price change, suspension or discontinuance of the Service.

Section 10 - Products or Services (if applicable)

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor 's display of any colour will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case -by - case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Section 11 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and / or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e - mail and / or billing address / phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Section 12 - Option Tools

We may provide you with access to third - party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools” as is” and“ as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third - party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third - party provider(s).
